Mark Roberts represented the owner of a gas station that was impacted by a gasoline release as the result of faulty installation of the station’s underground storage and distribution system. A claim was brought against the insurer for the gasoline system installer to recover judgment for damage to the property, interest, and bad faith damages for wrongful denial of claim. Mr. Roberts recovered a seven figure settlement, including substantial bad faith damages, in a mediation immediately prior to trial.
